ClarityPay, Inc. (“we” or “us” or “ClarityPay”) provides a point-of-sale financing platform that connects lenders (“Program Lenders”) and merchants that enable this technology (“Merchants”). ClarityPay provides technology and support services facilitating Program Lenders’ lending programs (the “Platform”). ClarityPay is not a bank, lender, or other financial institution, and we do not make credit decisions or extend credit.
You agree and consent to receive electronically all communications, agreements, documents, notices, and disclosures (collectively, "Communications") that we provide in connection with your application for a loan from a Program Lender and the servicing of any loan you receive from a Program Lender. Your consent gives ClarityPay, Merchants, and Program Lenders (collectively, “ClarityPay”) and their affiliates or companies working on their behalf permission to communicate with you electronically in regard to any activity related to the loan product, and is not specific to any loan, application, or transaction.
“Communications” include, but are not limited to, the following:
· communications about your loan application, including your interest rate, finance charges and APR, and the final terms of your loan;
· loan agreement and amendments to your loan agreement;
· terms and conditions and policies you agree to, including updates to these agreements or policies;
· initial or periodic disclosures;
· communications about payment amounts and due dates;
· payment receipts;
· notices of default;
· federal and state tax statements we are required to make available to you; and
· any other information relating to your payments to us.
We will provide these Communications to you by posting them on the account management website after you log-in or emailing them to you at your registered email address. It is your responsibility to keep your registered email address up to date so that we can communicate with you electronically. You can update your registered email address by logging into the account management website. You have the right to request paper copies of any Communication we are legally required to provide you. Paper copies of such Communications can be requested by emailing us at support@claritypay.com. Requests for paper copies will be fulfilled only for Communications we are legally required to provide you.
In order to access and retain electronic Communications, you will need to use the following computer software and hardware: A PC or MAC compatible computer or other device capable of accessing the Internet, access to an e-mail account, and an Internet Browser software program that supports at least 128 bit encryption, such as Microsoft® Internet Explorer, Netscape® or Mozilla Firefox®. To read some documents, you may need a PDF file reader like Adobe® Acrobat Reader Xpdf® or Foxit®. If these requirements change while you are maintaining an active relationship with us and the change creates a material risk that you may not be able to receive Disclosures electronically, we will notify you of these changes. You will need a printer or a long-term storage device, such as your computer's disk drive, to retain a copy of the Disclosures for future reference. You confirm that you have access to the necessary equipment and software to receive and save/print our Communications to you.
Consent is not a condition of obtaining a loan. You Have the Right to Withdraw Consent. You may withdraw your consent to receive Communications electronically at any time by emailing us at support@claritypay.com.
Any withdrawal of your consent to receive Communications electronically will be effective only after we have a reasonable period of time to process your withdrawal. If you withdraw your consent to receive such Communications electronically, that withdrawal of consent applies only to the Communications we are legally required to provide you, and we reserve the right to charge you additional fees for paper copies - up to $10 per document.
You acknowledge that we may amend this policy at any time by posting a revised version on the account management website. If we make a material change to this policy, we will also send a notice to your registered email address.
